Judicial & Government Testing Programs

There should be early and frequent judicial supervision of each diversion drug court participant. Judicial drug courts are authorized to require regular drug testing as a result of their case including:

Each participant should appear in court before a specifically assigned diversion drug court judge within 30 days after the first court appearance. At this time the participant should provide proof of registration, proof of completion of assessment, proof of entry into a specific treatment program, and initial drug test results.

The second drug court appearance should be held no later than 30 days after the first drug court appearance. The third drug court appearance should be held no later than 60 days after the second drug court appearance.

A final drug court appearance should be required no sooner than 12 months from entry into treatment unless continued treatment is found to be appropriate and necessary.

Interim drug court appearances should be required within one week of the following: positive drug test results, failure to test, adulterated test, or failure to appear or participate in treatment.

At each drug court appearance, the judge should receive a report of the participant’s progress in treatment and drug test results and should review, monitor, and impose rewards and sanctions based on the participant’s progress or lack of progress.

Most court ordered drug programs require regular and frequent drug screens. When urine drug screens are required by the courts, Transmetron uses observed urine drug screen collections.

Court Ordered Drug, Alcohol and DNA Testing Programs

Drug testing, alcohol testing, and DNA testing are often used by the courts to determine guidance in such cases as:

  • Judgments in divorces
  • Determine custody of children

The types of tests most ordered by the court:

  • Hair drug testing – which provides a historical record of substance use.
  • Urine screening & saliva testing – which provides a recent window of drug use. Most court ordered urine drug screen collections require observed urine collection.
  • Alcohol screening for recent use includes: saliva alcohol testing and breath alcohol testing.
  • EtG urine test – detects longer term alcohol use in urine (up to 80 hours). Also, often required for Interlock Restricted Drivers (IRD) who need their device reset in order to drive.
  • DNA tests (a legal paternity test) – which can determine maternity or paternity of any child in custody or family disputes.
  • Random alcohol testing – to comply with court orders.

Court Admissible DNA Paternity Tests

Transmetron provides court-admissible DNA paternity testing results to individuals.

In certain situations, court-admissible results are required. This means the test results must be accepted as evidence in a court of law. For a paternity test to be admissible in court, the tests and results must be handled according to specific legal procedures, carried out by one of our certified testing labs.

Why Would You Need a Legal Paternity Test?

If a mother was not married to her child’s father, she must legally establish paternity in order to collect child support payments. This is because she needs to prove paternity before she can obtain a court order for child support. More families than ever before need to establish paternity in the U.S., with a 377% increase in the number of children born to never-married parents over the past 10 years. Paternity may also need to be established if a couple was married but living apart when the child was conceived or if the couple was married and the husband denies being the biological father.

Our Paternity Testing Lab

Prenatal paternity testing is not offered by Transmetron. We recommend waiting until the child is born, as buccal swab testing is gentle enough to be performed on newborns right in the hospital! The DNA testing procedure takes place at your nearest Transmetron lab (off-site collections are available in certain cases).

Our lab’s legal DNA tests are highly accurate, excluding, on average, more than 99.999% of non-parents. DNA testing can also provide a high probability of paternity. Our lab’s testing protocols are designed to resolve routine questions of disputed paternity as well as less common cases, such as:

Our Lab performs testing on several different sample types. The most commonly used sample is the buccal swab. This type of sample is collected by swabbing the inside of the cheek (buccal cavity) with a sterile cotton swab.
